The Mediasender Inbox service allows recipients (including, by way of example and not limited to, radio broadcasters, television broadcasters and operators in the music industry) to receive, consult, listen to, download and centrally manage digital promo cards sent by senders, including music tracks, promotional materials and related informational content. The service is intended exclusively for the consultation, organization and management of content received through the Mediasender platform.
Access to the service is reserved exclusively for subjects deemed eligible by EarOne/Xdevel following the preliminary verification carried out on the data provided by the recipient through the appropriate data collection form.
The recipient guarantees that the data, information and any documentation provided for the purpose of requesting activation of the service are truthful, accurate, up to date and complete.
The recipient also undertakes to provide, upon request by EarOne/Xdevel, any additional information, clarifications or documentation necessary for preliminary checks, verification of eligibility to use the service or verification of the continued existence of the required eligibility requirements.
In the event of lack of cooperation, failure to provide the requested information or inability to carry out the necessary checks for reasons attributable to the recipient, the provider may suspend or revoke access to the service.
Access to the service takes place through personal credentials (email and password).
The recipient is required to keep their credentials strictly confidential and not to share them with third parties, remaining solely responsible for all activities carried out through their account.
The recipient is responsible for any use of the service carried out through their account, including unauthorized use resulting from failure to properly safeguard the credentials.
Digital postcards are sent by senders via email. The Mediasender Inbox service exclusively allows centralized consultation of received content but does not replace the recipient’s email inbox nor automatically guarantee the receipt of digital promo cards, whose management remains the sole responsibility of the senders.
The content available through the service may be used exclusively for professional purposes, such as listening, editorial evaluation, radio and television programming and internal management of music content, in compliance with applicable copyright and related rights laws.
The recipient declares and guarantees that, where required by applicable law in relation to the activity carried out, they hold the authorizations, licenses and/or permits necessary for the lawful public use of musical works and content protected by copyright and related rights, including, by way of example and not limited to, any SIAE and/or SCF licenses.
In the absence of the above-mentioned authorizations, use of the service shall be limited exclusively to private consultation of the content received through the platform. Any use of the content in violation of the above may result in the temporary or permanent suspension of the account and access to the service by the provider. It is furthermore expressly understood that the recipient shall be the sole and exclusive party responsible for any unauthorized use of musical works and content protected by copyright and related rights, holding EarOne/Xdevel harmless from any dispute, claim or controversy arising from the use of the content without the authorizations required under applicable law.
Any use of the content other than as specified above without authorization from the rights holders is prohibited.
The recipient undertakes to use the service in compliance with applicable national and international laws and regulations, as well as the rights of third parties, including intellectual property rights.
The recipient further undertakes to use the service in accordance with principles of fairness and good faith, avoiding any conduct that may cause damage to the service, the provider, the senders or other users.
The recipient is expressly prohibited from sharing, distributing or transferring received content to third parties; performing massive or automated downloads; using scraping tools, data extraction systems or automated collection of content; modifying, altering or manipulating received content; using the content for unauthorized commercial purposes; using the service or content in a manner that may damage the image, reputation or rights of the provider, senders or third parties; using received content for unauthorized sending activities, spam or any other unauthorized distribution; accessing or attempting to access restricted system areas; bypassing security or authentication systems; carrying out unauthorized vulnerability tests; engaging in conduct capable of compromising the operation of the platform; carrying out reverse engineering, decompilation, disassembly or any attempt to analyze the code or structure of the platform.
The content contained in digital promo cards is provided by the senders, who are solely responsible for it. The service provider does not perform prior checks on the content and does not guarantee its accuracy, completeness or updating.
The recipient uses the content under their sole responsibility, holding EarOne/Xdevel harmless from any liability arising from the use thereof.
The service may collect data relating to use of the platform, including views of digital promo cards, track plays and downloads performed, for statistical, technical, monitoring and service improvement purposes.
The Mediasender Inbox platform, including software, structure, layout, functionalities and related technological components, is the exclusive property of EarOne/Xdevel and is protected by applicable intellectual and industrial property laws.
The recipient acquires exclusively a limited, personal, non-exclusive and non-transferable right of use.
It is not permitted to transfer, share or distribute the service, in whole or in part, nor to allow access to unauthorized subjects.
The recipient undertakes, upon request by the provider, to provide information, clarifications or cooperation necessary for checks relating to use of the service, maintenance of eligibility requirements and compliance with these rules.
The service may be subject to updates, technical modifications, maintenance or temporary suspensions, including for reasons not attributable to the provider, such as network issues, technological infrastructure failures or third-party services, without this giving rise to liability on the part of the provider.
In the event of violation of these rules, improper use of the service, failure to cooperate with checks requested by the provider, communication of untruthful data or use of the content without the authorizations required under applicable law, the provider reserves the right to temporarily suspend or permanently revoke access to the service, even without prior notice.
These rules may be updated over time and any modifications will be communicated through the official service channels.
